
Reliability: I-DEP is committed to providing a minimum service
up-time level of 95% for every deposition we broadcast via the
Internet. In the event that a service interruption causes our up-time
level to fall below 95% for a particular deposition, I-DEP will
issue a service credit to the Client equal to the amount to have been
billed to the Client by I-DEP for its services. Service interruptions
will be considered in the aggregate, for example:
A 30-minute interruption in any feature during an eight-hour deposition
would constitute a 93.75% service up-time level and would qualify
for a full service credit.
The Client shall not receive a service credit if an interruption is (a)
caused by the negligence or willful misconduct of the Client or others
authorized by the Client to use the Services; (b) due to failure of power,
or any problem occurring at the broadcast site; (c) caused by the failure
of the Client's access to I-DEP's Services, unless such failure is solely
caused by I-DEP; (d) due to any cause outside I-DEP's systems or network,
including the Internet.
Latency: Latency, the delay between when the source signal is
initially sent and when that signal is properly received, is both highly
variable and is itself a function of numerous variables, the majority
of which are inherent to the Internet. With that understanding in mind,
I-DEP will put forth its best efforts, and assist our clients, to monitor,
identify, and if possible fix what elements are or could be causing any
problems of Latency. I-DEP will also quickly resolve any problems with
the elements causing Latency that are under our control.
